Trial delayed for man accused of running drug cartel

The trial of an allegedly key player in Chicago’s largest narcotics conspiracy was postponed today until Oct. 9.
Jesus Vicente Zambada-Niebla, allegedly the highest-ranking Mexican drug cartel leader to be tried in Chicago, had been scheduled to go on trial next month.
U.S. District Judge Ruben Castillo delayed the trial in part because of the complicated nature of the case. The evidence includes classified documents.

Officials at the Dirksen U.S. Courthouse beefed up security for Wednesday's hearing, posting a metal detector outside Castillo's courtroom that spectators had to pass through. Zambada-Niebla was one of dozens indicted in 2010 on charges of trafficking tons of cocaine and heroin into the Chicago area.

* It was after 2:30 pm when Judge Castillo entered the court. In a closed circuit screen, Zambada, who wore a whitie uniform with short sleeves, listening on a phone, while his co-defendant Tomas Renteria Arévalo, dressed in an orange uniform, listening to headphones translation of the proceedings.

Judge Castillo got to the point and set October 9 as the date to start the trial Zambada, son of Ismael Zambada Garcia, leader of the Sinaloa cartel with Joaquin "El Chapo" Guzman.
The trial was scheduled for February Zambada, but this was delayed due to delays in the process.

In deciding the new date, the judge said he wanted to delay the decision because he wanted to finish some decisions to review the documents on the immunity and extradition motions pending in court. In the rest of the audience, which lasted for several minutes, the judge scheduled the dates for motions Zambada lawyers and the government's response, on 30 March and 30 April respectively.

Castillo scheduled the next hearing for April 18.

** Zambada-Niebla has argued that his case should be dismissed because he was granted immunity in exchange for providing the US Drug Enforcement Agency with information about rival cartels.

Prosecutors have called his assertions both false and legally irrelevant.

Judge Ruben Castillo said at a status hearing Wednesday that it will take him at least three more weeks to wade through a huge stack of classified documents. He hopes to rule on the immunity argument and other motions shortly thereafter.

Castillo cautioned that the October 9 trial date may have to be pushed back as a result of the recent arrest in Mexico of top Sinaloa lieutenant Felipe Cabrera-Sarabia, who is also charged in the indictment. The US government is seeking his extradition.

Zambada-Niebla was extradited to Chicago in February 2010, nearly a year after his arrest in Mexico City.

The Sinaloa cartel has expanded rapidly through violent battles with its rivals and has intensified its global operations since elusive billionaire boss Joaquin "El Chapo" Guzman escaped from a Mexican jail in 2001.

Some 50,000 people have died in rising drug-related violence since the government of President Felipe Calderon deployed tens of thousands of troops to take on the cartels five years ago, according to media counts.

One has to wonder if the capture of Felipe Cabrera-Sarabia was a legal strategy to push is feb trial date back on behalf the Sinaloa team? Give them more time to prepare & shed light or expose the dirty deals they had with the gov.

It would not surprise me if German is captured in early to mid 2013. Defense will be able to postpone the actual trial until about late 2013 - early 2014. That of course if vincetillo doesn't get wacked for beefing on the US gov.
