The First Chamber of the Supreme Court endorsed an article that considers the production, trade and distribution of pornography as a crime that must be punished with sentences of five to 15 years in prison.
In the session of this Wednesday, the first of the Second Period of Sessions of 2018, the ministers estimated that this type of content aimed at adults should be considered exploitation and sexual offense.
Therefore, they declared constitutional the fraction III of article 10 of the General Law to Prevent, Punish and Eradicate Crimes in the Matter of Trafficking in Persons and for the Protection and Assistance of Victims .
Said article warns that it will be sanctioned with penalties of five to 15 years in prison, and a fine of one thousand to 30 thousand days, to which one benefits economically from the exploitation of a person through trade, distribution, exhibition, circulation or offer of books, magazines, writings, recordings, films, photographs, printed advertisements, images or objects, of a lascivious or sexual nature, real or simulated, either physically or through any means.
This law provides for the exception of material produced and distributed for purposes such as scientific, artistic or technical dissemination, as well as sexual or reproductive education.
This is unless a judge, after requesting an expert opinion to assess whether the material in question constitutes sexual exploitation or not, indicates otherwise.
