THE SUPREME COURT UPHELD THE HEALTH CARE REFORM LAW (5 OUT 4). AS OF NOW, IT IS FULLY IMPLEMENTED AND WILL CONTINUE. THE CHIEF JUSTICE ROBERTS WAS THE DECIDING FACTOR IN THE FINAL DECISION. A PERSON CANNOT BE PENALIZED FOR NOT PAYING FOR INSURANCE BUT CAN BE FINED A PENALTY AND IT SEEMS AS IF A HIGHER TAX RATE WILL BE PLACED IN ORDER TO PAY FOR THIS HEALTH CARE LAW.

THIS IS CONSIDERED A MORAL VICTORY FOR THE OBAMA ADMINISTRATION. IT REMAINS A LAW BUT IT IS STILL A TOUGH ROAD AHEAD FOR PRESIDENT OBAMA. THIS IS ALL NEW SO WE WILL SEE WHAT NEW OBSTACLES WILL AFFECT THIS LAW IN THE FUTURE.

A sad day for us Americans, but what a total BS of a ruling.

So now it's considered a "tax" if you don't buy insurance however Obama clearly stated multiple times while he was lobbying it that it wouldn't be a tax....

From the Get Go same Q WHO and HOW will this new Right to health care be paid for?? The USA is dead broke,are they all asleep at the Wheel?? Has ANYBODY looked to see that the Citys,States and the Fed are all in houge deficit positions,there is no MONEY,DUH. So how about this gigantic POLITICAL SHOW PIECE??

Obama promised the American people this wasn’t a tax and that he’d never raise taxes on anyone making less than $250,000. We now see that this is the largest tax increase in history. It will slam every business owner and every one of the 50% of Americans who currently pay their taxes. The other 50% are being deceived if they think they’re going to get a free ride – because Medicaid is broke. Recipients of Obama’s “free health care” will have fewer choices and less accessibility.

This much more expensive health care WILL be rationed; to claim otherwise defies all economic and common sense.

I could use a little help understanding this.

Insurance companies can no longer resist insurance to patients
Prior to OBC did insurance companies resist insuring a patient?

* People with pre-existing conditions cannot be turned down
My understanding is that pre-existing conditions of a insured was never canceled – insurance companies just kept jacking up the premium until the insured couldn’t afford a policy. Likewise a new insurer with a pre-existing condition was overly charged. Under OBC are there limits as to what an ins. company can charge for a pre-existing condition?


The millions that now have had insurance due to Obamacare will continue to be protected 
Will those already insured also have to pay a added tax to cover those who cannot afford insurance?


* Children from poor families will no longer be turned down by insurance companies.
Were they turned down before, or just couldn't afford ins? Is this funded through increased taxes?

Insurance companies will now have to provide health insurance to everyone except illegal immigrants 
Didn’t they provide insurance, for a fee, prior to OBC? Does this repeal the Fed. Law that states all people, regardless of origin is required to be served for illness in Hospitals?

* Over 30 million people will now be provided with health insurance
Prior to OBC wasn’t there a Federal Law that stated no one could be turned down for health care in hospitals? Thus the reason MX/US border region receive a lot of Fed Funds and another reason poor people go to the emergency room after 5pm.

* Higher taxes will be established
Without a doubt we will have higher taxes. Is it true that the burden on employers will equate to $2 an hour in costs?

The new The Affordable Health Care Act cannot be repealed
To my knowledge the Feds have never repealed anything. Please explain why it cannot be repealed. I ask because I have no awareness of same.

While we were all debating the cost to our liberty due to the Patient Protection and Affordable Care Act (Obamacare), we were ignoring the cost to our pockets.  If there ever was a reason for bipartisan rage about this law, it should be on the twenty - yes, twenty - hidden new taxes of this law.  Making matters even more relevant is that seven of these taxes are levied on all citizens regardless of income.  Hence, Mr. Obama’s promise not to raise taxes on anyone earning less than $250,000 is just another falsehood associated with this legislation.

The first, and best known, of these seven taxes that will hit all Americans as a result of Obamacare is the Individual Mandate Tax (no longer concealed as a penalty). This provision will require a couple to pay the higher of a base tax of $1,360 per year, or 2.5% of adjusted growth income starting with lower base tax and rising to this level by 2016.  Individuals will see a base tax of $695 and families a base tax of $2,085 per year by 2016.

Next up is the Medicine Cabinet Tax that took effect in 2011.  This tax prohibits reimbursement of expenses for over-the-counter medicine, with the lone exception of insulin, from an employee’s pre-tax dollar funded Health Saving Account (HSA), Flexible Spending Account (FSA) or Health Reimbursement Account (HRA).  This provision hurts middle class earners particularly hard since they earn enough to actually pay federal taxes, but not enough to make this restriction negligible.

The Flexible Spending Account (FSA) Cap, which will begin in 2013, is perhaps the most hurtful provision to the middle class.  This part of the law imposes a cap of $2,500 per year (which is now unlimited) on the amount of pre-tax dollars that could be deposited into these accounts.  Why is this particularly hurtful to the middle class?  It is because funds in these accounts may be used to pay for special needs education for special needs children in the United States.  Tuition rates for this type of special education can easily exceed $14,000 per year and the use of pre-tax dollars has helped many middle income families.

Another direct hit to the middle class is the Medical Itemized Deduction Hurdle which is currently 7.5% of adjusted gross income.  This is the hurdle that must be met before medical expenses over that hurdle can be taken as a deduction on federal income taxes.  Obamacare raises this hurdle to 10% of adjusted gross income beginning in 2013.  Consider the middle class family with $80,000 of adjusted gross income and $8,000 of medical expenses.  Currently, that family can get some relief from being able to take a $2,000 deduction (7.5% X $80,000 = $6,000; $8,000 –$6,000 = $2,000).  An increase to 10% would eliminate the deduction in this example and if that family was paying a 25% federal tax rate, the real cost of that lost deduction would be $500.

The fifth new tax on the middle class, and all Americans, is the Health Savings Account (HSA) Withdrawal Tax Hike.  This provision increases the additional tax on non-medical early withdrawals from an HSA from 10% currently to 20% beginning in 2013.  This provision actually sets these accounts apart from Investment Retirement Accounts (IRAs) and other tax advantaged accounts, all of which remain with a 10% early withdrawal tax.

Another regressive tax that is part of this law began in 2010 and that is the Indoor Tanning Services Tax, which places a 10% excise tax on people using tanning salons.  While some may regard this as insignificant, the broader implication is that this act of taxation is a blatant move by the federal government to control the behavior of citizens.  This provision, as does the Individual Mandate and as Justice Kennedy said during the oral arguments on the constitutionality of the law said, “….fundamentally changes the relationship between the federal government and the citizen.”

The seventh new tax that directly impacts the middle class, along with all citizens, is the Excise Tax on Comprehensive Health Insurance Plans or the “Cadillac” Health Insurance Plan Tax.  These are plans that provide extensive coverage and that are generally fully paid for, or largely paid for, by employers.  This provision imposes a 40% excise tax on the employer-paid premium on taxpayers who are covered by such plans, beginning in 2018.  The reason it begins in 2018 is because most unionized workers are covered by plans that fall under this definition and a deferral was made to spare union members from this tax for at least a period of time.

There are thirteen other taxes that apply to businesses and that apply to high income (over $250,000 per year) households.  While these additional provisions will not impact the middle class directly, they can have serious indirect consequences for middle and low income earners.  Beginning in 2014, the Employer Mandate Tax will impose an annual non-deductible tax on employers with more than 50 employees who do not provide health insurance for their employees.

The impact of this provision on low and middle income earners, and really all working Americans, is that employers will be confronted with three choices. The first is provide some level of health insurance, as many do today, and there would be no impact on employees.  The second choice is to pay the penalty, which would most likely be less expensive than providing health insurance, and force employees to seek their own health insurance or purchase it through federal government controlled state exchanges.  Studies have estimated that 20 million Americans will lose their employee funded health insurance as a result of this provision and employers electing this option.  The third choice is for employers to lay off employees, or not hire additional employees, because Obamacare forces them to either provide health insurance or pay the new tax.

Another new tax, the Tax on Medical Device Manufacturers that begins in 2013, places a 2.3% excise tax on all items retailing for more than $100.  This provision will not only drive up the cost of various medical devices ranging from mobility assistance devices to personal testing supplies, but will also impact an industry that employs 360,000 people in 6,000 plants across our country.  This tax, while not a direct tax, would have significant negative impact on the middle class.

The Surtax on Investment Income for households earning $250,000 and more, beginning in 2013, will raise the Capital Gains Tax from 15% to 23.8% on investment income for these households and will raise Taxes on Dividends from 15% to 43.4% for the same households.  Aside from the impact on retired citizens dependent on dividends, this provision will pull income from the private economy.  In addition, the tax rate on Other Investment Income earned by Subchapter S Corporation (which many small business are organized as, allowing the owners to claim all business income as personal income) will rise from 35% to 43.4%.  This part of the provision would place additional pressure on small businesses resulting in more layoffs and less hiring, impacting all American workers.

All but one of the remaining new taxes in Obamacare are directed at health industry businesses and while they will not impact middle income families directly, the additional costs will most likely be passed on to the public.  The last new tax is really interesting, it is a tax on certain biofuels!

These are the facts.  It does not matter if you support Mr. Obama and his new law or if you oppose it, the new taxes on the middle class or real and all Americans should understand their impact on their families and the economy.  Citizens, regardless of political beliefs, should recognize that Obamacare was passed with almost no sunlight shined on these middle class tax increases and need to understand that the new law was sold with the promise that there would be no new middle class taxes.  This is not partisan, it is simply the reality of politics.

I am only going to touch on a few of your points.

First:

This only applies if the person/family does not get medical insurance -- through their employer, an individual policy or Medicaid if they qualify. This doe NOTE apply to each and every citizen.

Oh, cry me a river! More whining, because there is penalty if you take money out of your medical account to use for something else. And, OMG, they raised it! Maybe, just maybe, it has been discovered that, since the procedures for those kinds of withdrawals are easier people are doing it more often than they do for IRAs, etc., so they need to up the penalty?

Fourth

Another regressive tax that is part of this law began in 2010 and that is the Indoor Tanning Services Tax, which places a 10% excise tax on people using tanning salons.
It has conclusively been proven that using a tanning bed significantly increases your chances of getting skin cancer -- yes, much, much higher odds than just laying out in the sun. Who's gonna pay for it when you have to have radiation and chemo since you wouldn't listen to the experts and stay of of the tanning beds? That tax.

These are the ones I know just off the top of my head. I am sure that if I did just a tiny bit of research (I think that seventh tax is made up) I could extend my list. Oh, and

You act as if I am the one who upheld the Health Insurance Bill. It was upheld by the Chief Justice Roberts (R) and it was a very smart choice. He usually leans towards the right but this time he decided to base his decision on moral truth, That and the fact that Roberts knew better. The Supreme Court is made up of mostly ignorant old conservative men who have the tendency to (lean) towards the right. Roberts didn't want people to view the Supreme Court as a joke. This decision brought back integrity to the Supreme Court. Had this Bill been rejected, It would of caused hysteria. (If it wasn't for the 3 women judges, this decision would have not been passed.)

You never complained when he decided on 'Citizens United'. This Bill would have been much better structured and democratic had the Republicans been in anyway willing to negotiate instead of being BIG PAINS IN THE ASSES. So because of the Republicans' unwillingness to compromise and because of their stubborn immaturity, They have lost a major defeat to their arch enemies and have also lowered the reputation of the GOP even worse than during the Bush Administration. And will this change their negative attitudes? NOPE. They will still remain the same 'Assholes'.

From this point on. In order for the Democratic Party to get any kind of Bill passed from the congress, they will have to play 'Hardball' with the Republicans. Being nice isn't going to move this country forward. The Republicans have forced the Democrats to fight hard and dirty just to get anything passed and so the GOP is now getting a sour taste of their own action. GOOD!

Other Republicans are coming out. Bush Sr. and Barbara Bush, Jeb Bush, Arnold Schwarzenegger, Jon Huntsman, Rudy Giuliani, John McCain, Andrew Cuomo, Susana Martinez, even Ann Coulter has complained about how difficult the conservative party has become.

So it's because of the GOP (Grand 'Old' Party) that we have so many problems with getting anything passed and it is hindering any of this countries' progression. Now, the representatives of the GOP are making threats that they are still going to try their hardest to get this Law repealed.

While the Democrats spent an additional $76 million on pro-health care ads just to defend the onslaught of negative ads that came from the (KROTCH) Brothers. Get it? KROTCH? Nevermind.

That's the way the Republicans won Wisconsin. They bought their way. The Republicans are so much in cahoots with the corporations now that it has become a travesty. And they have absolutely no shame about it. That's why the GOP will always defend the Oil companies. They know that we need to start focusing on alternative resources but the BIG corporate penis is so far up all of their asses, that they are willing to sacrifice the environment just for the sake of money, not for the betterment of this country. EVERYTHING TO THEM IS ABOUT $$$$$$$.


You know in your right mind that insurance companies love to play the Run-Around-Game with people who are dying. These insurance companies (all) love to abuse their privileges and they all take advantage of people when they are at their most vulnerable. Many people have died because the insurance companies didn't want to pay for a life saving surgery or for an organ transplant or for even regular check-ups. The insurance companies have mastered the art of manipulating contracts and the games that they play with the constant adjustments of people's premiums.

Watch the documentary SICKO and learn a lil' about these caring and professional insurance companies.

Many people's lives will be saved because of the new Affordable Health Care Act. A life is priceless my friend. I am not going to complain if it costs me an additional $1,200 a year, or however much it will cost, It is worth it. Where did you get the information that the new Health Care Law was going to cost $2.00 an hour of someone's paycheck? I bet you anything that you got that false information from a Republican. And an employer who has over 50 employees should provide health insurance for his workers.

This Law will be very hard to repeal. It would take the president, the senate and the house in order to get it thrown out with a vote of 60. I don't think that this will happen.

Romney would have to win the presidency first and I think that it's going to be very hard for him to beat Obama since Obama has a lead in key battle-ground states including Pennsylvania, Ohio and Florida. Not to mention, Obama is more popular with the Independents, women, Latinos, Blacks, Minorities in general, gays, college students and liberals.

Romney on the other hand, is the biggest flip-flopper in the world who can't make up his mind on 'anything' and won't yet take a stance on 'something'. He is plain and simple, just a business man from a private equity company who knows how to destroy businesses and profit from another person's loss. He is a coward. At least Obama has the balls to take a stance on something. He doesn't take shit from the terrorists and he doesn't take shit from the Republicans. Romney is full of shit. He has already promised that he is going to fight to remove universal health care on his first day as president (lol) and that he's going to be tough on China (BS) and that he's going to fix our economy by reducing taxes on the rich and he's going to take on Iran (more war) and he wants to reduce 10% of the federal workforce. I don't believe a word that he says. He has no balls to accomplish the things that he promises.

At least Obama has balls......RomneyCare, ObamaCare, Same shit. 98% of Massachusetts has health insurance now. They are a much happier and healthier state thanks to RomneyCare. Their economy is no worse than any other states' economy. In fact, Mass. economy has gotten better since Romney left. Romney is a fool and a hypocrite. He doesn't even stand by his own accomplishments.

You always make a very good point, even though we disagree some of the time. I wish most conservatives were like you, then we would be living in a civilized country. If I ever go off on the Republicans or conservatives, Don't ever take it personal. I am not thinking of you or someone like Buela Chivis when I talk bad about the GOP. I'm usually talking about the politicians and we both know that the Democrats are just as imperfect. It's just that we cannot all agree on everything and some of these subjects are very important to all of us. In this case, people's lives and people's finances are being affected during a very difficult time for everyone.
