Re: Judge and agent of Public Ministry executed in CD Victoria Tamaulipas
Jorge Fernandez, husband of the Spanish murdered in Mexico Pilar Garrido , was found guilty on Thursday of feminicide after a long and complex judicial process, a sentence that the defense has already announced that it will appeal.
"The decision of the Tribunal de Enjuiciamiento to the judgment was unanimous. And the number of years of sentence will be determined on Monday in another session, facing a penalty of 40 to 50 years, "said spokesman for the Northeast State of Tamaulipas, Luis Alberto Rodríguez.
"It was a very unfortunate decision, with a conviction," explained defense lawyer Jesus Eduardo Govea, who anticipated that the verdict will be appealed to a higher instance.
Garrido, a 34-year-old Valencian, disappeared on July 2, 2017 when she was traveling with her husband and baby in their car back to Ciudad Victoria, in the northeastern state of Tamaulipas, after spending a few days on the beach.
At the end of July, skeletal remains and tatters were found in a place near the place of disappearance, and 15 days later the DNA tests allowed identifying the Valencian woman.
Although at first the version of the husband was believed, who claimed that she had been kidnapped by two armed men, the case was overturned when the State Prosecutor's Office arrested Fernández on August 29, 2017, alleging contradictions in his statements.
The Tamaulipas Public Prosecutor's Office accused the husband of killing the Spaniard by "suffocating by strangulation", and throughout the trial, which started on August 30, 2018, witnesses allegedly witnessed mistreatment of experts in forensic sciences and anthropologists. sustain this version.
For their part, Fernandez's lawyers defended the innocence of the husband, a native of Tamaulipas, alleging inconsistencies in the evidence provided by the prosecution and the impossibility of actually determining the causes of the death of the Spaniard.
This same week, Rosa María and Raquel, mother and sister of Pilar Garrido, testified by videoconference in favor of her husband, describing a positive family environment, in which they had never witnessed mistreatment.
The same sentenced, in an interview with Efe last August, defended his innocence. Although, a fervent devotee since he entered prison in August 2017, he left in the "will" of God his own destiny and his "thirst for justice".
The family of Fernandez is devastated after the outcome of this trial, which has suffered serious setbacks since it began with the abandonment of several defense lawyers, who denounced that the Prosecutor's Office threatened to uncover an old event that could tarnish his name.
The murder at gunpoint of one of the judges of the court and one of the prosecutors in the middle of December last in the streets of Ciudad Victoria also delayed the development of the judicial process, postponing the sentence to January, and making visible the severe insecurity that this state.
"This is a horrible Roman circus. Even the judge rapporteur to read the (sentence) read only the evidence of prosecutors and even provided more, "said Jorge Fernandez father Efe, who considered that this case reflects the situation in the state.
"It's a dump, it's rotten," he cried.
The father of the sentenced explained that, after being made known the sentence, his son turned around and asked his parents calmly, assuring that there is no "to lose the faith".
Fernandez father has announced that, with the team of lawyers, the ruling will be appealed to all possible instances, also at the federal level.
And in turn, he demanded security from the authorities of Tamaulipas, because he fears for the life of his son and his own.
"They want to cover the sun with a finger, and look good with the Kingdom of Spain, closing the case of a shelving," he concluded.
Govea pointed out that it is going to appeal to the superior instance of the Court of Prosecution, which is the Supreme Court of Justice of the state.
First, the ordinary process has to be exhausted, and in case of future adverse failures, a means of constitutional control could be proceeded with an amparo trial at the federal level, he said.
